In its current draft format the South African Climate Change Bill (the Bill) fails to consistently recognise the urgency of the climate emergency and the need for a just transition in South Africa. The most glaring omission however is the Bill’s failure to unambiguously declare that we are in a climate emergency. A number of other concerns also raised in this submission, if not addressed, could render these regulations vulnerable to legal challenge.
